GENERAL TERMS AND CONDITIONS – la Gym
Article 1 – Definitions
la Gym: la Gym, located in Breda (Keizerstraat 19G, 4811HL Breda), provider of fitness, training, and coaching services.
Member / Client: any natural person making use of the services of la Gym.
Agreement: the agreement between la Gym and the client relating to memberships, class packs, training sessions, or other services.
Booking system: the online system (Virtuagym) used to book and manage classes, trainings, and memberships.
Article 2 – Applicability
These general terms and conditions apply to all services, memberships, class packs, and purchases made via the booking system and the webshop of la Gym.
By entering into an agreement, the client agrees to these terms and conditions.
Article 3 – Memberships & Class Packs
Memberships and class packs are personal and non-transferable.
Class packs have a limited validity period as stated at the time of purchase. Unused classes expire after this period and are not refundable.
Memberships are entered into for the agreed duration (monthly or yearly) and are automatically renewed unless cancelled in time.
Membership fees are charged every four (4) weeks, unless explicitly stated otherwise.
Article 4 – Payment
Payment is made in advance via the online booking system or webshop.
Membership fees are collected automatically by direct debit.
In the event of late or failed payment, la Gym reserves the right to temporarily suspend access to classes and services.
Any costs resulting from failed payments may be charged to the client.
Article 5 – Reservations & Cancellations
Classes and training sessions must be booked in advance via the booking system.
Cancellations can be made free of charge up to 24 hours before the start of the class.
Late cancellations (within 8 hours before the start of the class) or no-shows may result in:
deduction of one class from the class pack, or
a no-show fee of €12.50 for members.
la Gym reserves the right to cancel or reschedule classes in cases of insufficient participation or force majeure.
Classes with only one registration eight (8) hours before the start time may be automatically cancelled.
Article 6 – Opening Hours & Public Holidays
Opening hours may vary.
Adjusted opening hours may apply on public holidays.
Current opening hours are communicated via the booking system or the website.
Article 7 – Health & Liability
Participation in classes and training sessions is at the client’s own risk.
The client declares to be physically fit to participate and will consult a medical professional in case of doubt.
la Gym is not liable for injury, damage, or loss of personal belongings unless caused by intent or gross negligence.
la Gym is not responsible for theft or loss of personal items.
Article 8 – Personal Training & Coaching
Personal training and coaching are tailored to the individual client but do not guarantee specific results.
Personal training sessions must be cancelled in accordance with the agreed cancellation policy.
Article 9 – Webshop & Right of Withdrawal
Digital products, memberships, and class packs are delivered immediately after purchase.
Due to immediate delivery, the statutory right of withdrawal does not apply, in accordance with Article 6:230p of the Dutch Civil Code.
Refunds are not possible unless la Gym decides otherwise.
Article 10 – Children During Classes
Babies are welcome only during designated Baby & Me classes.
In exceptional cases, and only if no childcare can be arranged, children may be brought along at the client’s own responsibility.
Children must not cause disturbance or inconvenience to:
the instructor
other clients
the class or training session
If this condition is not met, the instructor reserves the right to deny participation in the class or to ask the client to leave the session.
Article 11 – Conduct & House Rules
Clients are expected to behave respectfully towards instructors and other members at all times.
la Gym reserves the right to refuse access to the studio or terminate an agreement in cases of inappropriate behavior.
Article 12 – Privacy
la Gym processes personal data in accordance with applicable privacy legislation (GDPR).

Article 13 – Price Changes & Indexation
la Gym reserves the right to adjust prices due to indexation, inflation, or cost increases.
Price changes will be communicated at least two (2) weeks in advance.
Article 14 – Amendments
la Gym reserves the right to amend these terms and conditions.
The most current version is always available on the website.
Article 15 – Governing Law
All agreements are governed by Dutch law.
Any disputes will be submitted to the competent court in the Netherlands.
